Camellia Catering terms and conditions
These terms and conditions aim to protect all parties through a better understanding of contractual and legal obligations of both the client and the caterers when confirming a booking for catering.
Definitions: ‘We’, ‘us’ and ‘our’ means Camellia Catering. The ‘client’, 'you' and ‘your’ mean the organising body/company and organiser responsible for commissioning of and payment for the event. The house ‘House’ meaning Mount Edgcumbe Country Park.
Venue Hire refers to the fee levied against the use of the Orangery building. A 50% deposit is required upon booking made payable to Mount Edgcumbe Country Park. The remaining 50% of the venue hire fee is also payable to Mount Edgcumbe Country Park 1 month prior to your event; VAT is applicable to the hire fee.
Booking and reservations
a. Your booking is confirmed with us when we receive your booking form from the House and your catering deposit of £500 has been paid. All bookings are subject to our terms and conditions.
b. Your catering pack will be sent out by email at the beginning of each year and must be completed and returned 1 month prior to your reception along with your completed table sheets with your guest’s choices on them.
c. Any variation in booking, guest numbers and/or arrangements after the forms have been submitted must be confirmed to Camellia Catering in writing.
d. You will be expected to provide us with individual name cards for each of your guests with their menu choices on them. The name cards must be submitted to us in table order the day before for your reception were we will have a final run down of your day.
e. Set up starts at 10am on the morning of your reception and all suppliers must drop off and set up 2 hours prior to your start time.
f. Suppliers and band meals will be supplied at a cost of £27 per person.
g. We do not permit bands or suppliers to have tabs but will take pre-payment for a requested figure if it is part of their Ryder.
h. Evening buffets will be catered for no later than 8:30pm and minimum numbers must be above 60 people.
i. No food shall be permitted to be brought into the premises from external caterers or guests, with exception to your wedding cake.
j. Anything left overnight at our venues must be collected the following day before midday. We do not allow any band our DJ equipment to stay overnight.
Payments
a. Full pre-payment is required for all receptions.
b. A catering deposit of £500 is required and is non-refundable.
c. The full balance of your catering invoice is due 1 month prior to your reception.
d. A 2.5% per month interest charge will be added to amounts unpaid.
e. If there is a query with the invoice, the undisputed balance must still be paid on time.
f. The organiser shall be responsible for the payment of all the fees and royalties, which may be due in respect of the event to the Performing Rights Society, Phonographic Performances Ltd, the Copyright Licensing Agency Ltd, the Educational Recording Agency Ltd, or any other relevant person, firm or organisation.
g. We do not except cheques and all payments must be made by bank transfer using your full name and reception date as the payment reference. We do except credit card however payments will incur a 3% charge.
h. All prices except the hire fee are inclusive of VAT at current rate and are subject to the rate in operation at the time of the function.
Cancellation
Upon acceptance and confirmation of your booking, a legally binding contract exists. If you are forced to cancel your booking for any reason no refunds will be issued.
We reserve the right to cancel an event under the following circumstances:
- If the booking might, in the opinion of Camellia Catering or the House, prejudice the reputation of the venue, endanger listed structures or adversely affect community relations in any way.
- If the client is more than 28 days in arrears with any payment to Camellia Catering.
- Camellia Catering becomes aware of any alteration in the clients financial situation.
- The venue, or any part of it, is closed due to circumstances beyond our control. In this event a refund of any advance deposit will be paid but Camellia Catering would have no other liability.
General Regulations
a. Guests using our venues must comply with all regulations concerning licensing, fire, health and safety.
b. Hazardous or dangerous items may not be brought into the venue without prior permission. The venue reserves the right to approve any externally arranged entertainment, services or activities.
c. It is the responsibility of the third party to provide all method statements, risk assessments and insurance for all activities conducted on site, all must be provided on request.
d. Any band or musician must comply with the terms stated within the 'public entertainment code of conduct. Bands must finish playing by 11pm, drum kits are not permitted at the Orangery and sound levels must be set to a reasonable level. If the band do not respect the sound levels set by the manager the band will be forced to stop.
e. Should guests act in an improper or disorderly way, or refuse to comply with reasonable requests from our staff, we reserve the right to terminate your stay or event. Should this occur, no monies will be refunded to you. The manager's decision is final.
f. Guests may not consume food or drink on the premises not supplied by the Camellia Catering.
g. Camellia Catering will be liable to you and your guests for injury, loss or damage only where and to the extent we have been negligent. Otherwise there shall be no liability whatsoever. We regret that we cannot be responsible for the security of your property, though we will do our utmost to look after it.
h. You will be held liable for any loss or damage to the venues property and fittings (including any items hired by us for your use), or for injury to anyone including the venues staff arising as a consequence of this booking.
i. Camellia Catering reserves the right to charge for any additional services requested during the event if you do not adhere to agreed timings.
j. We strongly recommend taking out adequate insurance to cover the cost of cancellation and other liabilities.
k. All conditions are subject to the law of England and Wales.
